What is SENACLAFT?
La SENACLAFT (National Secretariat for the Fight against Money Laundering and Terrorism Financing) is the agency responsible for coordinating national policies aimed at preventing and combating these crimes. This entity reports to the Presidency of the Republic and works with public and private stakeholders to ensure transparency in financial and commercial operations.
Why does Uruguay require a sworn declaration of origin of funds?
As part of the measures to prevent money laundering, every person carrying out a real estate transaction must declare the legitimate origin of the funds used. This requirement is not a mere formality, but a mandatory step aimed at protecting the integrity of the country's financial system. This document is known as the Affidavit of Origin of Funds, and the law requires it of both buyers and sellers. It simply consists of stating in writing the origin of the funds used to purchase the property and attaching the supporting documents.
Although sometimes perceived as a bureaucratic burden, the Affidavit of Origin of Funds also protects the buyer. It ensures that their investment is protected against potential investigations or asset freezes resulting from dubious transactions.
Real Estate Agencies: Non-Financial Obligated Subjects
Within this framework, real estate companies are classified as "Non-Financial Obligated Entities." This means we must comply with a series of legal obligations, such as:
